An overview of why it is important to work with a probate attorney when selling probate property, including, but not limited to, specific language that must be included in a real estate contract when probate property is involved, the timing of putting the property on the market, working through tricky requirements in a title commitment, and determining who has the authority to sell property when the owner is deceased or incapacitated (e.g., personal representative, trustee, attorney-in-fact) and what type of deed is required (e.g., personal representative deed, trustee deed, etc.)
