OKCMAR TERMS & CONDITIONS OF MEMBERSHIP

1. Persons other than principals, partners, corporate officers or branch office managers of real estate or appraisal firms must remain employed by or affiliated with a Designated REALTOR® (member broker) to be eligible for REALTOR® membership.

2. I agree to abide by the bylaws, policies, rules & regulations of the Association, the bylaws, policies and rules of the National Association of REALTORS®; all as may from time to time be amended.

3. I understand that the National Association of REALTORS® requires an orientation and mandatory training on the Code of Ethics.

4. I authorize the Association or its representatives to verify the information provided by me in this application by any method including contacting the Oklahoma Real Estate Commission, my current or past responsible broker, and/or any association where I held, or continue to hold, any type of membership to release all my membership or disciplinary records to this association, including information regarding:

  1. all final findings of Code of Ethics
    violations and other membership duties within the past three years;
  2.  pending ethics complaints (or hearings);
  3. unsatisfied discipline pending;
  4. pending arbitration requests (or hearings);
  5. unpaid arbitration awards or unpaid financial obligations. I understand that any information gathered under this authorization may be used in evaluating my application or membership and future disciplinary sanctions.

I waive any legal claim or cause of defamation of character that may arise from any action taken to verify, evaluate or process this application or other use of the information authorized and released hereunder.

5. A condition of membership in the Association as a REALTOR® is that you agree to binding arbitration of disputes. As a REALTOR® (including Designated REALTOR® and Broker Associate) member, you agree for yourself and the corporation or firm for which you act as a partner, officer, principal, or branch office manager to binding arbitration of dispute with:

  1. other REALTOR® members of this Association;
  2. with any member of the Oklahoma or National Association of REALTORS®; and
  3. any client provided, provided the client agrees to binding arbitration at the Association. Any arbitration under this agreement shall be conducted using the Association facilities and in accordance with the Association rules and procedures for arbitration.

6. As a condition to membership, I agree to complete the indoctrination course of the Oklahoma City Metropolitan Association of REALTORS®, Inc. and otherwise on my own initiative to thoroughly familiarize myself with the Code of Ethics of the NATIONAL ASSOCIATION OF REALTORS®, including the duty to arbitrate contractual and specific non-contractual disputes in accordance with Article 17 and the Code of Ethics and the Code of Ethics and Arbitration Manual of the Association, and Bylaws and Rules and Regulations of the Oklahoma City Metropolitan Association of REALTORS®, Inc. and the Oklahoma Association of REALTORS® and the Constitution, Bylaws and Rules and Regulations of the NATIONAL ASSOCIATION OF REALTORS®, and I further agree to complete satisfactorily a reasonable and non-discriminatory written examination covering such Code, Constitution, Bylaws, Rules and Regulations, and duty to arbitrate. I further agree that my act of paying dues shall evidence my initial and continuing commitment to abide by the aforementioned Code of Ethics, Constitution, Bylaws, Rules and Regulations, and duty to arbitrate, all as from time to time amended.

7. As a condition of membership in the Oklahoma City Metropolitan Association of REALTORS®, Inc., I hereby agree and consent to submit to arbitration by this Association and, only if appropriate, by the Oklahoma Association of REALTORS®, disputes and controversies that I may have with a member associated with a different firm arising out of the real estate business and to abide by the arbitrator’s award. Such arbitration shall be conducted in accordance with the Bylaws, rules and procedures established by this Association, or, if appropriate, by the Oklahoma Association of REALTORS® and the Code of Ethics and Arbitration Manual of this Association as amended from time to time.

8. I consent and authorize the Association to invite and receive information and comment about me from any Member or other person. I further agree that any information and comment furnished to the Association by any Member or other person in response to the invitation shall be conclusively deemed to be privileged and not form the basis of any action by me for slander, libel or defamation of character.

9. NOTE: Applicant acknowledges that the Oklahoma City Metropolitan Association of REALTORS® Inc. will maintain a membership file of information which may be shared with other boards/associations where applicant subsequently seeks membership. This file shall include: previous applications for membership, all final findings of Code of Ethics violations and violations of other membership duties within the past three (3) years; pending complaints alleging violations of the Code of Ethics or alleging violations of other membership duties; incomplete or pending disciplinary measures; pending arbitration requests; and information related to unpaid arbitration awards or unpaid financial obligations to the Oklahoma City Metropolitan Association of REALTORS® , Inc. or its MLS.

10. NOTE: Applicant acknowledges that if accepted as a member and he/she subsequently resigns or is expelled from membership in the Association with an ethics complaint or arbitration request pending, the Board of Directors may condition renewal of membership upon applicant’s verification that he/she will submit to the pending ethics or arbitration proceeding and will abide by the decision of the Hearing Panel; or if applicant resigns or is expelled from membership without having complied with an award in arbitration, the Board of Directors may condition renewal of membership upon his/her payment of the award, plus any costs that have previously been established as due and payable in relation thereto, provided that the award and such costs have not, in the interim, been otherwise satisfied.

11. NOTE: Dues payments to the Oklahoma City Metropolitan Association of REALTORS®, Inc. are not tax deductible as charitable contributions. Portions of such payments may be tax deductible as ordinary and necessary business expenses. Please consult your tax advisor.
